Lady Berry Terms & Conditions
Lady Berry Cupcakes reserve the right to alter our terms & conditions at any time.
Bookings & Payments
All bookings (including parties, classes, and events) are non-refundable.
A non-refundable deposit is required at the time of booking to secure your event or class.
The remaining balance must be paid in full no later than 7 days before the event.
If payment is not received by this time, we reserve the right to cancel your booking and retain the deposit.
Cancellations & Rescheduling
We do not allow cancellations or rescheduling once a booking has been confirmed.
No refunds or credits will be issued for missed classes or events under any circumstances.
Travel Charges
All events hosted outside our studio will incur a travel fee, calculated based on our time and a mileage.
This charge will be added to your invoice and must be paid in full before your event.
Children’s Parties & Classes
For all children's parties and classes, an adult must be present at all times.
Children may not be dropped off and left unattended during the event.
Online School & Video Classes
Online classes are provided as streaming-only. Video content cannot be downloaded.
Your access remains available as long as the online platform is operational and supported by Lady Berry Cupcakes.
In the event the online school is closed or migrated to a different platform, we will make reasonable efforts to inform users, but access may be removed at any time.
We recommend completing your courses promptly after purchase.
Gift Vouchers
Gift vouchers are valid for six (6) months from the date of issue.
Vouchers are non-refundable, cannot be exchanged for cash, and must be used within the validity period for the person on the gift voucher.
Product Orders & Shipping
We occasionally sell cupcakes and plan to offer fondant toppers in future. All products are made to order.
Once an order is placed, it cannot be cancelled or refunded.
Shipping costs (if applicable) will be calculated at checkout or discussed during ordering.
Digital Products
Any digital guides or content offered through our online school are view-only.
You do not have permission to download, duplicate, or share this content.
All intellectual property remains the sole property of Lady Berry Cupcakes.
Liability & Conduct
We are not liable for any allergies, dietary issues, or accidents that occur during your class, party, or event. It is your responsibility to inform us of any allergies in advance.
We reserve the right to refuse service to any customer who is rude, abusive, or disrupts the experience for others.
Student Belongings:
Lady Berry Cupcakes cannot accept responsibility for any loss of or damage to personal belongings brought to class. Students are advised to keep their personal items with them at all times and to avoid bringing valuables where possible.
Intellectual Property
All images, videos, course content, and branding belong exclusively to Lady Berry Cupcakes.
You may not copy, replicate, or redistribute any of our material without written permission.
Intellectual Property – Updated for 2025
All content shared by Lady Berry Cupcakes across our website, Facebook, Instagram, TikTok, Pinterest, and any other official platforms is the intellectual property of Lady Berry Cupcakes. This includes, but is not limited to, designs, photographs, course content, written guides, mentoring materials, lesson plans, class formats, and teaching techniques.
By attending a class, workshop, or online session with Lady Berry Cupcakes, you agree not to copy, reproduce, imitate, or use any of this content for commercial purposes.
If you currently run or intend to run baking, cupcake, cake, or cookie classes/workshops of your own, you may not use any of the designs, content, or techniques learned from Lady Berry Cupcakes for the promotion or delivery of your own classes or business. This includes using photographs of your work created during a Lady Berry Cupcakes class to advertise or promote your own offerings.
It is strictly prohibited to replicate or teach any part of Lady Berry Cupcakes’ intellectual property, and doing so may result in legal action being taken against you or your business.
We appreciate your understanding and respect for the creativity, hard work, and originality that goes into every Lady Berry Cupcakes class.
Corporate & Bespoke Events
For large-scale or corporate events, a bespoke agreement may be issued in addition to these terms.
Any changes to guest numbers, venue access, materials, or schedule made within 7 days of the event may incur additional charges and must be agreed in writing.
All invoices must be paid in full at least 7 days before the event unless otherwise agreed.
Attendance
Please ensure you arrive on time for your Lady Berry Cupcake class. If you arrive more than 10 minutes late, you may not be permitted to join the class, as this can cause disruption and impact the experience of other students. In such cases, your booking will be forfeited, and we are unable to offer a refund or transfer to another date. We recommend allowing extra time for your journey to avoid disappointment.
All personal belongings brought to the class are the responsibility of the attendee. Lady Berry Cupcakes accepts no liability for any items that are lost, stolen, or damaged during your time on the premises or after your departure.
Discounts & Sales
From time to time, Lady Berry Cupcakes may offer promotional discounts on selected classes. These offers are available only to customers who book during the advertised sale period. Sale prices will be clearly displayed on the website for the duration of the promotion.
Please note:
Bookings made before or after the sale period are not eligible for discounted rates, partial refunds, or retrospective discounts.
Discounts are only valid for new bookings made within the promotional window and cannot be applied to existing or previously confirmed bookings.
Force Majeure
By booking a class, workshop, or party with Lady Berry Cupcakes, you acknowledge and accept that Lady Berry Cupcakes is not liable for any delay, cancellation, or inability to deliver services due to circumstances beyond our reasonable control. These may include, but are not limited to: acts of God, government restrictions or regulations, natural disasters (including floods, fires, or earthquakes), pandemics or epidemics, power or transportation shortages, strikes or labour disputes, war, civil unrest, or any other event that makes it commercially impractical, illegal, or impossible to proceed.
Should such an event occur, Lady Berry Cupcakes will notify affected clients as soon as reasonably possible. In such cases, we reserve the right to reschedule or make alternative arrangements where possible, but no refunds will be issued due to force majeure circumstances.
Indemnification
By booking with Lady Berry Cupcakes, customers agree to indemnify, defend, and hold harmless Lady Berry Cupcakes, its owners, staff, and affiliates from and against any claims, losses, liabilities, damages, expenses, or legal fees arising from any breach of terms, incorrect information provided at the time of booking, or actions taken by the customer or their guests during a class, workshop, or event.

Some classes or resources may require you to create an account on our platform. You must provide accurate, up-to-date information during registration and keep your login credentials secure. You are solely responsible for any activity that occurs under your account.
1.3 Intellectual Property
All content provided through the Lady Berry Cupcake School—including but not limited to video tutorials, class materials, guides, and downloadable resources—is protected by copyright and intellectual property laws. You agree not to copy, share, modify, or use any of this content to create derivative works or to teach others without prior written permission from Lady Berry Cupcakes.
Use of the Platform
2.1 Access and Availability
Access to the platform and its content is granted for as long as the platform remains operational. Lady Berry Cupcakes reserves the right to update, suspend, or discontinue any part of the platform, class offerings, or content without prior notice.
